Most Common Law Cases

In January 2020, forty civil lawsuits were filed in Washington County for a questionable amount of more than $10,000. There are several notable Supreme Court decisions that, regardless of the outcome, have survived decades and continue to affect the rights of Americans today. These are the 7 famous Supreme Court cases that defined a nation. On January 8, 2016, the District Court issued a permanent injunction against Downing Labs, LLC, Ashley Downing, Christopher Downing and Roger Mansfield. FDA inspections over the past three years have revealed several repeated violations of the Food, Drug and Cosmetic Act (FDCA) by reducing the manufacture of compound sterile injectable drugs. Downing and its immediate predecessor, NuVision Pharmacy, Inc., falsified compound sterile injectable drugs by preparing them under unhygienic conditions and using methods or controls that did not conform to current good manufacturing practices. For example, summer 2014 inspectors found that 19 batches of Downing`s drugs had tested positive for various microorganisms, including Staphylococcus haemolyticus, which can cause sepsis, peritonitis, and urinary tract infections, and Nocardia nova, which can cause pneumonia, sinusitis, and skin infections. These quantities of drugs were not distributed in interstate trade. After the final inspection, at the request of the FDA, Downing voluntarily recalled all sterile, non-expired injectable drugs that had been distributed and ceased manufacturing/composition of sterile injectable drugs. Under the proposed executive order, Downing will be banned from manufacturing drugs in violation of the FDCA and will have to cease operations until the FDA determines that the company has brought its conduct into compliance with the law.

The court also ordered Dallal to confiscate $250,000 in ill-gotten gains. Dallal has previously been charged in Puerto Rico County and southern Ohio County for selling illegally obtained prescription drugs linked to two different drug diversion programs. Dallal obtained the drugs from several illegal and unauthorized sources and sold them to co-conspirators without the required genealogical record indicating where Dallal had purchased the drugs. In both cases, Dalpal`s co-conspirators then sold the drugs to wholesalers and pharmacies across the United States with false genealogical records that did not reveal the true sources of the drugs. The cases were consolidated for pleading and sentencing purposes in Puerto Rico. On December 5, 2014, Dallal pleaded guilty to two counts of conspiracy to commit mail fraud and transfer. We chose this date because the number of complaints decreased during the COVID-19 pandemic, and we chose to review court records before that date.

The court found that this promise, as well as Ms. Carlill`s intended use of the product, constituted a legally binding contract and that she was entitled to the reward.
